  • First-offense (misdemeanor DUI): First-offense DUI can result in penalties including 10 days to six months in jail (minimum jail time may be reduced to 24 hours with participation in an alcohol treatment/diversion program), 90 days to 360 days license suspension, fines and other consequences.
  • Second-offense (misdemeanor DUI): A conviction for second-offense DUI can result in 30 days to 90 days in jail, one-year license suspension, costly fines and other penalties.
  • First-offense extreme (misdemeanor DUI): Driving under the influence with a blood alcohol content (BAC) of .15 or higher can result in elevated penalties for extreme DUI, including a minimum 30 days in jail, 90 days license suspension, enhanced fines and surcharges and other penalties
  • Second-offense extreme (misdemeanor DUI): Second-offense extreme DUI (BAC of .15 or higher) can result in elevated penalties including 120 days in jail, one-year driver's license revocation, costly fines and surcharges and other consequences.
  • Aggravated (felony DUI): Aggravating factors, such as driving under the influence while on a suspended license, with a minor in the vehicle or with two or more prior convictions for DUI within the past 84 months (seven years) can result in enhanced charges and penalties. Penalties for a third DUI offense within seven years include a minimum four months in jail, three-years license revocation, costly fines and surcharges and other consequences.
